These Terms of Service (“Terms”) are a contract between you and Outgoing Voice (“Outgoing Voice,” “we,” “us,” or “our”) governing access to our website, demos, and the multi-tenant control plane for outbound AI calling (the “Service”). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you can bind that organization, and “you” includes that organization.
Not legal advice. These Terms do not advise you on TCPA, state telemarketing, or other calling laws. You remain responsible for lawful basis, lists, disclosures, and program design. See also our Compliance page and Privacy Policy.
Outgoing Voice provides software for organizations that already run outbound calling programs: campaign configuration, pre-dial compliance gates, suppressions, escalations (callback tickets), dry-run testing, call review, and related operator documentation. Telephony and AI speech modules may be integrated as they become available; features may be preview, beta, or limited.
We may change, suspend, or discontinue features with reasonable notice when practicable. Demo data, sample calls, and product tours are for illustration only and are not live carrier traffic unless clearly labeled otherwise.
If you place or configure outbound calls through the Service, you are the calling entity (or act for one). You alone are responsible for:
The Service’s pre-dial gate enforces policy you tag on campaigns; it does not certify that your consent or exemption is legally sufficient. You warrant that your use of the Service will not cause us to violate applicable law.
You will not, and will not allow others to:
We may investigate and suspend use that we reasonably believe violates this section or creates risk to callees, customers, or the public.
Speech-to-text, language models, text-to-speech, and telephony may be provided by us or third parties. Outputs can be inaccurate, incomplete, or inappropriate. You must supervise campaigns, review escalations, and not rely on the agent for legal, medical, or financial advice to callees beyond your approved scripts and tools.
Third-party terms and privacy policies may apply to provider services. Availability and latency of carrier and AI providers are outside our exclusive control.
You retain ownership of data you submit (lists, scripts, consent metadata, recordings you own, etc.) (“Customer Data”). You grant us a non-exclusive license to host, process, transmit, and display Customer Data solely to provide and secure the Service, prevent abuse, and as described in the Privacy Policy.
You represent that you have all rights and notices required to process Customer Data (including callee personal data) through the Service.
The Service, software, branding, documentation, and product tour content are owned by Outgoing Voice or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription or pilot, subject to these Terms. No rights are granted except as expressly stated.
Paid plans, usage-based telephony or AI costs, and pilot terms may be set out in an order form, pricing page, or written agreement. Unless otherwise agreed, pilots may be limited in time, volume, or features and may be revoked. Beta or preview features are provided “as is” and may change or end without liability.
You are responsible for taxes and for carrier or provider pass-through charges where applicable.
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the compliance gate will detect every unlawful or unwanted call. We do not warrant legal compliance of your outbound programs.
To the maximum extent permitted by law, Outgoing Voice and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to the Service or these Terms, even if advised of the possibility. Our aggregate liability for all claims in any twelve-month period will not exceed the greater of (a) amounts you paid us for the Service in that period or (b) one hundred U.S. dollars (USD $100) if you are on a free pilot or unpaid access.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
You will defend, indemnify, and hold harmless Outgoing Voice and its personnel from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your Customer Data or calling programs; (b) your breach of these Terms or law; (c) alleged TCPA, telemarketing, privacy, or consumer claims related to calls you initiate or configure; or (d) disputes between you and callees or your end clients (e.g. BPO relationships).
You may stop using the Service at any time. We may suspend or terminate access for breach, legal risk, non-payment, or prolonged inactivity. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive.
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless a written order form specifies otherwise. Courts in Delaware (or another venue we both agree in writing) shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.
